If you have renter's insurance - file a claim through your insurance company. They will help you with who is responsible for what. Other than that, I'm not sure what your recourse will be, it depends on local law.

BTW - that really, really sucks.

Your apartment building management is responsible for the damage that is done to the unit, however, it is pretty unlikely they would pay for or be legally responsible for your contents. Assuming you have renter's insurance and the damage to your contents is significantly higher than your deductible, that's what insurance is for.

As an insurance agent, I see tons of water damage type claims. Most people don't realize that it is probably the most common type of claim there is (except maybe theft). Water can do a surprising amount of damage in a very short time.

What @wnyx585am wrote is perfect... don't file a claim (if you have insurance) unless the damage is significantly more than your deductable.

Note however that if it is a condo, you (or your insurance) may very well be responsible for repairing the damage within your unit (you should ask them to fix it at their expense, but if they say no, you may have to eat it or sue for it and risk having to eat the legal costs as well as the repairs). If it is a rental or co-op, the building should be responsible for all of the repairs, but not your stuff.

BTW- I know how much it can suck to come home to a flood. Mine was over three years ago and only last week I discovered two more books that I hadn't realized got wet... One cost me $45 in St John seven years ago and will cost over $362 to replace, the other was a signed gift that will cost $88 to replace without a signature. And a month ago I learned that the first edition Carrie I had might have been worth thousands...

Last time I had to make an insurance claim, I called twice in one day. 1) I was driving my Truck in snow on a dirt road and my 4WD cut out. I took out a mailbox, a speed limit sign, and did $2500 worth of damage to my truck. 2) We left a candle lit after dinner, it set the center piece on fire, burnt our 30+ year old dinning room table, smoke damage throughout the whole house, and damaged various items in the same room. Luckily, we caught it early and put it out fast. And no one was hurt in either incident. We haven't had to make a claim before or after that day. But we were "in good hands" with Allstate!
