@jedinc: I am guessing that would be how you load Android. The difference is with the Nook, the SD card has Android and you can pop it out and B & N would be none the wiser. AFAIK, once you root the actual device, as you would through the micro-USB on either device, the original OS is gone and should you have any issues with it while under warranty, you could be out of luck for repair.

For those wondering about rooting, etc:

I am running ICS on my Fire. The steps are just about everywhere online, but the long and short of it is you install a boot and backup tool that you can then store your factory installation on, then load a restore that contains the ICS build. So even with it rooted and updated you can get back to factory if you need to return it or go back for any reason

@waystevens: The return process is very easy with the Kindles. I know because my wife received a Touch as a gift in March and we upgraded to the Fire at the $169 price. Now I will return that one (which will probably arrive tomorrow) and get it at the $139 price. You loose the return shipping, but still come out ahead.

I got one of these the last time they were on sale at this price a few weeks ago, and I am loving it.

I rooted the device and currently run CM7 on it (Hellfire Edition), and it runs very smoothly and does everything an android device should, all for this amazingly low price. The new kernel is moving along very fast and there are already are/will be some great ics roms for the KF very soon.

One disclaimer: The samsung galaxy tab 2 is out now and for 250 bucks may very well be a better buy if you don't mind the higher price. It isn't that much more expensive new and comes with ICS and has cameras, a mic, and an sd slot.
